What is the effect of the legislative changes to car insurance in New Brunswick?
 
On June 13, 2003, the New Brunswick government introduced changes to the regulations under the Insurance Act which affect a car accident victim's ability to recover damages for injuries sustained.
 
These changes only affect people who have injury claims arising from a car accident after July 1, 2003. If you were injured before July 1, 2003 your rights have not been affected.
 
For those who are subject to these new regulations, the limitations imposed by the government are as follows:
A. In order to recover damages for pain and suffering, your injuries must be a serious permanent disfigurement or a serious permanent impairment as defined in the regulation.
 
B. If you do not meet that test, your damages for pain and suffering are limited to $2,500.00
 
At this point in time, which injuries will satisfy the above tests has yet to be determined by our Courts.
 
In addition, a person's claim for loss of wages, loss of earnings capacity, loss of homemaking capacity, loss of competitive advantage and damages for future care are NOT affected.
